Legislative Council for Odisha, Resolution passed in Assembly

The Odisha Assembly passed the resolution by 104 votes to set up the Legislative Council on 6 September 2018 under Article 171(1) of the Constitution. The Resolution will be sent to the Center for approval. The proposed legislative council will have 49 members. Odisha has total 147 members in the Legislative Assembly. The members of a Legislative Council are not directly elected by voters.
Currently, seven states including Andhra Pradesh, Bihar, Jammu and Kashmir, Karnataka, Maharashtra, Telangana, and Uttar Pradesh have a Legislative Council. Under Article 169, a Legislative Council can be formed “if the Legislative Assembly of the State passes a resolution to that effect by a majority of the total membership of the Assembly and by a majority of not less than two-thirds of the members of the Assembly present and votingâ€. According Article 171(1) of the Constitution, the legislative council of a state cannot have more than one third members of the total strength of the Legislative Assembly.
